“Denying a president’s immunity is not an easy decision,” Judge Amit Mehta wrote in an 112-page report. The court is aware of the weight of this decision.

But Mehta said Trump’s actions that day were “entirely related to his efforts to win a second term in office.” The speech, which the ex-president gave before the storming, can also be interpreted, according to the judge, as a call for collective action. Therefore, Mehta believes that presidential immunity will not apply.
