If you do not want to get a vaccine in the United States, it can be very difficult in growing places. For example, all federal government officials will be asked to get vaccinated. It’s about millions of people. Deniers often have to be tested, constantly wearing masks and keeping distance, Biden announced tonight. In extreme cases, this can lead to the dismissal of some officers who work with vulnerable individuals.
The business community is also picking on the threshold: Google and Facebook want to allow only those who have been vaccinated into the workplace. Netflix makes vaccinations mandatory for all actors and staff in American studios. The number of American universities that require proof of vaccination is now 400.
The body is untouchable
Anders and the United States, France and Italy, Dutch employees Rachel Rietvelt, an employment law researcher at the University of Amsterdam, clarifies that Dutch employees cannot be obligated to be vaccinated. “This would be a violation of Article 11 of our Constitution: the right of infringement of the body. In principle, it gives priority to everything.”
AVG, public data protection regulation is important. “This applies to everyone. It follows that your employer is not allowed to ask for your health data. For example, if you are sick you do not have to answer questions about your complaints. You have the right to privacy. You do not have to answer. A company doctor may know this, but is not allowed to do anything with information. “
Not just shooting
But Reidveldt says exceptions should always be made. “This is the beauty and often the hardest thing about the law. For example, you have a legal article on good workmanship and capitalism. It can always come in handy in certain cases. You work as a healthcare worker in an IC. You do not want to be vaccinated. The hospital may need to work in the field. The argument is that critically ill patients need to be protected. It is a broader interest that goes beyond personal rights. “
This should not lead to layoffs, which only apply in extreme cases, Rietweld insists. “That health argument does not apply to a factory where employees work in an assembly line. An employer can then take less drastic measures such as placing mudcards.”
FNV, the largest staff organization, says the debate here in the Netherlands has not really taken place yet. “But our position is clear: a vaccine duty is a violation of a fundamental right, so it should not be imposed by the government and employers,” a spokesman said.
Vaccine readiness is high
This has been confirmed by the employers’ organization VNO-NCW. “At the moment, this debate is neither among our members nor against it. Unlike the United States, the Netherlands (90 per cent) has the highest vaccine preference, and current Dutch law does not allow it.”
