Mariah Carey, 55, has asked a judge to dismiss a copyright lawsuit over her Christmas song “All I Want For Christmas Is You,” Billboard reports.

“Alleged similarities between songs are unprotectable.”

In November, songwriter Vince Vance sued Carey for a second time. He claims she copied his global hit. The lyrics and chords are said to be more than 50 percent similar to his 1989 song of the same name performed by his group Vince Vance & the Valiants. Plaintiff Troy, who claims he co-wrote the song with Vance, supports him in the case.

In documents filed in federal court in Los Angeles, attorneys for Carey and her co-writers say the lawsuit is without merit. “The alleged similarities between Vance and Carey’s songs that Plaintiffs allege are unprotectable,” the defense says. “They contain common elements that Vance and Carey use in different ways in their lyrics and their different music in general.”

In 2022, Vince Vance, whose real name is Andy Stone, filed the same claim, seeking $20 million in damages at the time. He eventually dropped the case himself, allowing him to try again now.
